1. VALIDITY
This agreement is subject to the full and timely payment of the amounts stated on the front of this yacht charter contract. Payments, including VAT, must be made in full prior to boarding. No modifications to the agreed amounts or terms shall be valid unless expressly authorized by the LESSOR.
2. CHARTER WITH CAPTAIN
If the vessel is rented with a captain, the captain will be provided by the LESSOR and will act on its behalf. The captain will hold the appropriate qualifications, experience, and licenses required for the planned navigation. Only the designated captain is authorized to operate the vessel. In case of malfunction or the need for repair or towing, the captain is the sole person authorized to make the necessary decisions to safeguard the vessel. The LESSEE agrees to respect and follow the captain’s instructions in such situations.
3. CHARTER WITHOUT CAPTAIN
If the vessel is rented without a captain, the LESSEE agrees to provide a qualified skipper with the appropriate certification and experience for the intended navigation. Only the designated skipper may operate the vessel. The LESSOR reserves the right to perform a sea trial with the provided skipper. If the LESSOR determines that the skipper lacks sufficient experience, a professional captain will be assigned at a cost of €150, payable by the LESSEE. Refusal to accept the appointed captain will result in the cancellation of the charter and the forfeiture of the deposit.
4. DURATION
The duration of the charter shall be as agreed on the front of this contract. One day of rental equals eight hours. Any extension requires prior approval from the LESSOR. If the LESSEE exceeds the eight-hour limit, an additional €100 per extra hour or part thereof will be charged. The vessel must return to port before 9:00 PM.
Delays in returning the vessel will be charged at double the daily rental rate, unless otherwise agreed. The charter is not considered finalized until the boat is handed over to an authorized representative of the LESSOR.
The vessel must be returned with full fuel tanks. Otherwise, the LESSEE will be charged for the fuel cost plus a €30 refueling service fee. If fuel is included in the final agreed price, the tanks need not be refilled.
5. INSURANCE
The vessel and its crew are insured with a reputable company that covers any accidents involving the boat. Neither the LESSOR, the captain, nor the vessel shall be held responsible for personal injuries or material damages during the charter, especially those related to activities such as diving, swimming, water skiing, wakeboarding, small boats, jet skis, or any other water sports.
The insurance policy is held by the LESSOR and is available for inspection by the LESSEE upon request.
Use of auxiliary equipment or jet skis is permitted only if the operator holds the appropriate license and assumes full responsibility. Their use must be authorized by the crew and limited to designated areas.
Expenses incurred from using water toys will be covered by the LESSEE. The LESSOR accepts no responsibility for water toys not included in the boat’s inventory. Their proper use is the sole responsibility of the LESSEE and/or the equipment owner.
The parties agree that this contract exclusively covers the rental of the vessel described in Section 1. The use of jet skis, seabobs, or similar devices during the charter will be entirely at the LESSEE’s own risk.
The LESSEE is solely responsible for any damages to persons, property, or the rented vessel caused by such use, and will be liable with their present and future assets. This clause serves as full exemption of liability for the LESSOR.
6. CANCELLATIONS
If the LESSEE cancels more than 30 days before the charter date, 50% of the deposit will be forfeited.
If the cancellation occurs within 30 days, 100% of the deposit will be forfeited.
If the LESSOR delays the vessel’s delivery by more than two hours and is unable to provide a boat of equal or superior quality, the full rental amount will be refunded.
7. DELIVERY INSPECTION
At the time of delivery, both parties will inspect the vessel and review the inventory. By signing, both parties confirm that the vessel and equipment are in satisfactory and seaworthy condition.
8. PROPER USE
The LESSEE agrees to use the vessel responsibly and maintain it in good condition. The LESSEE is liable for any damage, loss, or theft of items listed in the inventory.
All boats are equipped with GPS tracking.
In skippered-less charters, the LESSEE agrees to:
- Not exceed a speed of 30 knots
- Avoid dangerous maneuvers
- Avoid restricted or hazardous areas marked on the GPS
Violations of these terms, even without visible damage, will result in a €200 deduction from the deposit.
9. SECURITY DEPOSIT
The deposit will be held by the LESSOR as security for compliance with the contract terms and to cover:
- Damages due to negligence or misuse
- Fuel replacement
- Special provisioning requested by the LESSEE
- Port fees (except base port mooring, which is included)
The deposit must be paid by VISA or MASTERCARD upon boarding.
It will be refunded within 48 hours after the charter, once the vessel and inventory are inspected.
In case of accidents, grounding, or negligence, the LESSOR reserves the right to retain part or all of the deposit.
The minimum deposit is €1,500, and may be up to €5,000, depending on the vessel.
10. COMPLIANCE WITH REGULATIONS
The LESSEE must comply with all maritime, police, and health regulations in visited ports.
The LESSEE shall not exceed the vessel’s maximum passenger capacity, and must use the vessel exclusively for recreational purposes.
Commercial activities, subletting, fishing, transportation, and racing are strictly prohibited.
Violations will make the LESSEE solely liable.
If such actions result in the vessel being held by authorities, the LESSEE must compensate the LESSOR with the daily rental rate for the duration of the retention.
In case of vessel confiscation, the LESSEE must reimburse the LESSOR for the full value of the boat within 10 days, as determined by the insurance policy.
11. BREAKDOWN
If the vessel becomes unusable due to a fault not caused by the LESSEE, the LESSOR will provide a replacement vessel of equal or better condition.
If no such vessel is available, the LESSEE will be refunded for unused charter days.
If the issue is caused by misuse or negligence, no refund will be given.
12. BAD WEATHER
If weather conditions are unfavorable (e.g., east winds over 20 knots or rain), the LESSEE may reschedule the charter at no cost.
If rescheduling is not possible, the charter may be canceled with a full refund.
13. EXPENSES
Unless otherwise stated, the LESSEE is responsible for:
- Fuel and lubricants
- Port fees (excluding base port)
- Provisions, catering, and any consumables required for vessel operation and comfort
14. PROHIBITIONS
Cooking, smoking, or transporting animals on board is prohibited unless expressly authorized by the LESSOR.
Illegal drugs and weapons are strictly forbidden.
Only beverages provided by the LESSOR are permitted on board.
15. RETURN CONDITIONS
The LESSEE agrees to return the vessel in the same condition as it was at the start of the charter. Final cleaning will be carried out by the LESSOR. However, negligence, improper use, mistreatment of the vessel, or violation of the law or this agreement will result in immediate termination of the contract, with all amounts paid retained by the LESSOR as compensation.
16. IMAGE RIGHTS
The LESSOR reserves the right to use and publish for commercial purposes any images or videos taken during the rental, provided that the LESSEE and other passengers tag the LESSOR’s company and share their content on the LESSOR’s social media accounts.
17. MINORS
Minors must always be accompanied or supervised by an adult and are not under the responsibility of the crew. All minors must wear life jackets throughout the duration of the charter.
18. GRATUITIES
Tipping the crew is customary but entirely voluntary and at the discretion of the LESSEE.
19. PERSONAL BELONGINGS
The LESSOR is not responsible for any loss or damage to the personal belongings of passengers during the charter period.
20. WEATHER CANCELLATION
If the LESSOR or the CAPTAIN considers weather conditions unsuitable for navigation, the charter will be rescheduled or the total amount paid will be refunded.
21. FUEL PRE-AUTHORIZATION
The LESSOR will apply a Visa/MasterCard pre-authorization of at least €300 (depending on the vessel) to cover fuel costs. Upon return, the fuel tanks will be inspected and any used amount will be deducted from the pre-authorized amount. The remaining balance will be refunded to the LESSEE within 48 hours after the end of the charter.
22. JURISDICTION
For any disputes arising from the content or interpretation of this agreement, both parties expressly waive their own jurisdiction and submit to the Courts and Tribunals of Ibiza, where the LESSOR has its registered address.
23. COVID-19 POLICY
If the LESSEE is unable to use the vessel due to COVID-19-related circumstances, including travel restrictions or illness, they will be entitled to a full refund of the amounts paid. Alternatively, the LESSEE may request a change of dates, subject to availability.
